By downloading, installing, or using Buena Vida Run Club, you agree to be bound by these Terms of Service.
Please read these terms carefully before using the app. If you do not agree to these terms, do not use Buena Vida Run Club.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Buena Vida LLC ("Company," "we," "us," or "our") regarding your use of the Buena Vida Run Club mobile application (the "App").
By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.
If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You must be at least 17 years of age to use Buena Vida Run Club. If you are between 17 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
By using the App, you represent and warrant that:
We strongly recommend that you obtain medical clearance from a qualified healthcare provider before starting any fitness program, especially if you have heart conditions, high blood pressure, diabetes, are pregnant, have joint or bone problems, or have not exercised regularly in the past year.
Buena Vida Run Club does not require you to create an account or provide personal information. All data is stored locally on your device.
You are solely responsible for:
We are not responsible for any loss of data due to device failure, App deletion, iOS updates, or any other cause. We strongly recommend enabling iCloud backup if you wish to preserve your data.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use.

The App and all content, features, and functionality (including but not limited to software, text, graphics, logos, icons, images, audio clips, training plans, workout programs, and nutritional guidance) are owned by Buena Vida LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
"Buena Vida Run Club," the Buena Vida logo, and other marks are trademarks of Buena Vida LLC. You may not use these trademarks without our prior written permission.
You retain all rights to the data and information you create and store in the App. We do not claim ownership of your personal fitness data, workout logs, or nutrition entries. Since all data is stored locally on your device, we have no access to it.
BUENA VIDA RUN CLUB IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. The App is designed for general fitness and wellness purposes only.

We make no guarantees or promises regarding fitness outcomes, weight loss, performance improvements, or health benefits from using the App. Individual results vary widely based on factors including genetics, current fitness level, nutrition, sleep, stress, adherence to programs, and overall health status.
While we strive to provide accurate and up-to-date information, we make no representations or warranties regarding the accuracy, reliability, or completeness of any content in the App. Fitness and nutrition science is constantly evolving, and recommendations may change over time.

When you click on a third-party link, you leave the App and are subject to that third party’s terms and privacy policy. We encourage you to review the terms and privacy policies of any third-party sites you visit.
If you import runs or activities from Strava, you acknowledge that:

Buena Vida Run Club requires an active subscription to access the App’s features and functionality. All subscriptions are managed through Apple’s App Store.
By subscribing to Buena Vida Run Club, you agree that:
Subscription pricing and available plans are displayed in the App and in the Apple App Store. We reserve the right to modify subscription prices at any time. Price changes will not affect your current subscription period but will apply upon renewal unless you cancel.
You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation will take effect at the end of your current billing period, and you will retain access until that time.
All payments are processed by Apple and are subject to Apple’s refund policies. Refund requests must be made directly to Apple through the App Store. We do not process refunds directly. You can request a refund from Apple by:
We do not offer refunds for partial subscription periods, unused time, or dissatisfaction with the App.
If your subscription expires, is canceled, or payment fails, you will lose access to the App’s features. Your locally stored data will remain on your device, but you will not be able to use the App’s functionality until you renew your subscription.
Your subscription is subject to Apple’s App Store Terms of Service and Payment Terms. In the event of any conflict between these Terms and Apple’s terms regarding billing and subscriptions, Apple’s terms shall prevail.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, Buena Vida LLC disclaims all warranties, express or implied, including but not limited to:
No advice or information, whether oral or written, obtained by you from us or through the App shall create any warranty not expressly stated in these Terms.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
IN NO EVENT SHALL BUENA VIDA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY:
This limitation applies to claims based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy fails of its essential purpose.
In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have paid us (if anything) to use the App, or one hundred dollars ($100), whichever is less.
We are not liable for any actions, content, information, or data of third parties, including affiliate partners, race organizers, or running clubs that may be featured in future versions of the App.
You agree to indemnify, defend, and hold harmless Buena Vida LLC, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, actions, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and litigation costs) arising out of or relating to:
This indemnification obligation will survive termination of these Terms and your use of the App.
These Terms commence on the date you first download or use the App and continue until terminated by either you or us.
You may terminate these Terms at any time by deleting the App from your device and ceasing all use.
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if:

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

It is your responsibility to check these Terms periodically for changes. The current version will always be available within the App.
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@buenavida.app. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 60 days of submission, you or we may bring a formal proceeding.
You and Buena Vida LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement or misappropriation of intellectual property rights.
The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in the English language and shall take place in the county where Buena Vida LLC’s principal office is located, unless the parties agree otherwise.
YOU AND BUENA VIDA LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Unless both you and we agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
Notwithstanding the above, either party may bring a lawsuit in court if the claim is solely for injunctive relief to stop unauthorized use or abuse of the App or intellectual property infringement.
You have the right to opt out of binding arbitration within 30 days of first accepting these Terms by sending written notice to legal@buenavida.app with your name and a statement that you opt out of arbitration. If you opt out, all other parts of these Terms will continue to apply.
These Terms and any disputes arising out of or related to the App shall be governed by and construed in accordance with the laws of the State where Buena Vida LLC is registered, without regard to its conflict of law provisions.
To the extent arbitration does not apply, you agree to submit to the personal jurisdiction of the state and federal courts located in the applicable jurisdiction for the purpose of litigating all such claims or disputes.
If you download the App from the Apple App Store, you acknowledge and agree that:
The App may be subject to U.S. export control laws and may be subject to export or import regulations in other countries. You agree not to export, re-export, or transfer the App in violation of any applicable laws or regulations.
If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable, or if that is not possible, it will be severed from these Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Buena Vida LLC regarding the use of the App and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding such subject matter.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice to you. Any attempted assignment in violation of this section shall be void.
